PRODUCT SAFETY, USE, INSTALLATION, WARRANTY, AND LIABILITY NOTICE

This Product Safety, Use, Installation, Warranty, and Liability Notice applies to products manufactured, sold, supplied, or distributed by Smith Ranch Texas, LLC, doing business as SRT Metalworks (“SRT Metalworks,” “SRT,” “we,” “us,” or “our”).

This notice applies to all SRT products, including metal signs, wall art, yard art, garden stakes, tree-mounted art, wind spinners, brackets, hangers, tool holders, tables, stands, custom-fabricated products, fire pits, rocket stoves, outdoor cooking products, modular products, apparel, lighting components, accessories, and custom design or fabrication services.

Product-specific warnings, instructions, descriptions, approved uses, and limitations are incorporated into this notice. When a product-specific instruction is more restrictive than this general notice, the product-specific instruction controls.

IMPORTANT WARNING

SRT Metalworks products may involve cut metal, rigid edges, pointed design features, substantial weight, moving components, heat, open flames, hot surfaces, smoke, sparks, carbon monoxide, electrical components, or installation hazards.

Failure to properly unpack, handle, assemble, install, inspect, maintain, or use a product may result in cuts, puncture wounds, pinching, crushing injuries, burns, fire, carbon monoxide poisoning, falling objects, property damage, serious personal injury, or death.

Read all product information and warnings before handling, assembling, installing, or using any product.

The purchaser is responsible for providing this notice and all product instructions to every installer, user, gift recipient, subsequent owner, or other person who may handle or use the product.

1. General Cut-Metal Handling

SRT products made from CNC plasma-cut, sheared, bent, welded, or otherwise fabricated metal may include rigid edges, corners, points, narrow sections, detailed cutouts, mounting tabs, slots, and surface irregularities.

Although fabrication and finishing processes are used to reduce burrs and unintended roughness, cut-metal products must always be handled carefully.

Wear suitable cut-resistant work gloves when unpacking, carrying, assembling, cleaning, installing, removing, or relocating metal products.

Do not slide bare hands or fingers along metal edges, corners, cutouts, slots, mounting holes, tabs, or pointed design features.

Inspect each product before handling or installation. Stop handling or using the product if it has been damaged during shipping, has an unexpectedly hazardous edge, is cracked, bent, unstable, or otherwise appears unsafe. Contact SRT Metalworks before proceeding.

Metal products are not toys. Keep products, packaging, small components, pins, fasteners, and mounting hardware away from children and pets.

2. Metal Signs, Wall Art, and Decorative Products

Metal signs and wall art are decorative products and are not intended to be used as toys, climbing devices, handrails, grab handles, barriers, protective guards, structural supports, or load-bearing equipment.

The purchaser or installer is responsible for choosing an installation location that minimizes foreseeable contact with edges, corners, projecting features, and pointed design elements.

Do not install metal décor:

Over beds, cribs, playpens, or sleeping areas
Where a falling item could strike a person
In children’s play areas
In narrow walkways or low-clearance areas
Near stairs or emergency exits
Where people may regularly brush against or walk into it
Where doors, gates, vehicles, equipment, livestock, or moving objects may strike it

Mount every product securely using fasteners, anchors, brackets, and installation methods appropriate for the product’s size, weight, mounting points, wall construction, and intended location.

Unless expressly stated otherwise, mounting hardware is not selected or supplied for every possible mounting surface. The purchaser or installer is responsible for determining whether drywall, masonry, wood framing, metal siding, fencing, posts, or other surfaces can safely support the product.

Use a qualified installer when the proper mounting method is uncertain.

Inspect installed products periodically and after storms, impacts, construction work, or movement of the mounting surface. Tighten or replace loose, corroded, damaged, or unsuitable hardware immediately.

3. Outdoor Signs and Yard Art

Outdoor products must be installed to withstand reasonably anticipated wind, weather, vibration, animal contact, lawn equipment, and environmental exposure.

Secure outdoor items so they cannot fall, tip, rotate unexpectedly, detach, or become airborne.

Do not place rigid metal artwork, stakes, spikes, or pointed products where people, children, pets, livestock, vehicles, mowers, or other equipment may accidentally contact them.

Products with stakes or ground spikes present a puncture and impalement hazard. Install them in a visible location away from running, playing, walking, and vehicle paths.

Before driving any stake, spike, anchor, or post into the ground, identify underground electrical lines, communication lines, irrigation systems, gas lines, water lines, septic components, and other buried utilities. Contact the appropriate utility-locating service before installation when required.

Tree-mounted products and tree spikes must not be placed at eye level or in locations where a person may walk, climb, work, mow, or operate equipment nearby.

Remove or secure outdoor products before hurricanes, tornadoes, severe thunderstorms, extreme winds, or other conditions that could cause them to detach or become airborne.

4. Wind Spinners and Moving Metal Art

Wind spinners and kinetic metal products contain moving metal components that may create pinch, cut, impact, or entanglement hazards.

Install the product where it has sufficient clearance to rotate without striking people, animals, buildings, vehicles, windows, utility lines, furniture, vegetation, or other objects.

Keep hands, hair, loose clothing, jewelry, cords, and other items away from the spinner while it is moving.

The included swivel, pins, or connectors do not eliminate the purchaser’s responsibility to provide a secure overhead support point and any additional hanging hardware appropriate for the installation.

Inspect swivels, hooks, pins, hanging wire, chains, supports, and attachment points regularly. Immediately remove the product if any component is worn, bent, corroded, damaged, or loose.

Remove wind spinners during severe weather or unusually high winds.

5. Garden Stakes, Tree Spikes, and Pointed Outdoor Products

Garden stakes, tree spikes, and similar products are intended for stationary decorative or identification purposes only.

They are not toys, tools, weapons, climbing aids, livestock-control devices, or protective barriers.

Keep pointed ends directed into the intended mounting surface and away from people and animals. Do not leave pointed products lying on the ground or partially installed.

Do not install pointed products near pools, trampolines, playground equipment, sidewalks, doorways, driveways, sports areas, or locations where a person could fall onto them.

6. Tool Holders, Brackets, Hangers, Tables, and Stands

Tool holders, brackets, shelves, pipe hangers, display stands, tables, and similar products must be securely installed and used only for their stated purpose.

Unless a specific load rating is expressly stated in writing by SRT Metalworks, the product has not been represented as having a particular load capacity.

The purchaser or installer is responsible for:

Confirming that the mounting surface can support the product and its contents
Selecting suitable anchors and fasteners
Distributing weight properly
Avoiding overloading
Inspecting welds, hardware, tabs, slots, and mounting points
Keeping people clear of objects that could fall

Do not climb, sit, stand, hang, swing, or pull on a product unless the product listing expressly states that it is intended for that use.

Do not use decorative brackets, holders, tables, stands, or hangers for overhead lifting, fall protection, towing, vehicle recovery, personnel support, child restraint, animal restraint, or other life-safety applications.

7. Fire Pits, Rocket Stoves, and Open-Flame Products

DANGER: FIRE, BURN, AND CARBON MONOXIDE HAZARD

SRT fire pits, rocket stoves, and other fuel-burning products are intended for responsible adult operation in an open-air outdoor location only.

Burning wood, charcoal, or other solid fuel can produce carbon monoxide, an odorless gas that can cause serious injury or death.

Never operate or place a burning, smoldering, or recently extinguished product inside or within:

A house
Garage
Shop
Barn
Tent
Canopy
Vehicle
Trailer
Recreational vehicle
Camper
Enclosed porch
Shed
Greenhouse
Covered structure
Partially enclosed area

Do not use a rocket stove as an indoor or enclosed-space emergency heater. During a power outage or emergency, operate it outdoors only.

Do not operate near doors, windows, vents, air-conditioning intakes, or other openings through which smoke or combustion gases may enter a building.

Place the product on a stable, level, noncombustible, heat-appropriate surface where it cannot tip, shift, collapse, or be knocked over.

Do not use directly on wood, composite decking, dry grass, leaves, combustible flooring, or any surface that can ignite, melt, discolor, crack, or otherwise be damaged by heat, sparks, or embers.

Maintain sufficient clearance from buildings, roofs, fences, vehicles, fuel containers, trees, vegetation, outdoor furniture, power lines, and all other combustible materials. Follow all applicable fire-code clearance requirements.

Do not use during:

Burn bans
Drought restrictions
High winds
Red-flag fire conditions
Severe weather
Any condition prohibited by a fire authority, property owner, campground, municipality, county, or other governing entity

Use only the fuel identified for the particular product. Unless expressly stated otherwise, use dry, untreated natural wood.

Never burn treated lumber, painted wood, pressure-treated wood, plastics, trash, chemicals, tires, oils, solvents, or unknown materials.

Never use gasoline, alcohol, diesel fuel, kerosene, lighter fluid, solvents, or any other liquid fuel or accelerant to start, strengthen, or restart a fire.

Never add fuel to a fire in a way that could cause sudden flare-up, flame jetting, spilled burning material, or loss of control.

Keep an appropriate and immediately accessible fire-extinguishing method nearby.

Never leave a burning, smoldering, or hot product unattended.

Maintain constant adult supervision and keep children, pets, bystanders, loose clothing, and combustible materials a safe distance away.

All parts of the product may become extremely hot, including surfaces that do not appear to be directly exposed to flame. Hot metal can remain dangerous long after visible flames are extinguished.

Use suitable heat-resistant gloves, tools, and protective clothing. Do not touch, move, disassemble, transport, cover, store, or place the product near combustible materials until the fire is fully extinguished, all embers are cold, and every component has completely cooled.

Dispose of ashes and embers only after they are completely cold and in accordance with local fire requirements.

8. Rocket Stove Assembly and Modular Fire Products

Slip-fit, pinned, collapsible, or modular products must be fully and correctly assembled before use.

Follow the intended panel orientation, tab placement, slot engagement, pin placement, door placement, vent arrangement, and cookware-support configuration.

Do not operate the product when:

A panel, pin, tab, support, door, or component is missing
Tabs or slots are not fully engaged
The assembly rocks, leans, separates, or appears unstable
Heat distortion or damage prevents correct assembly
The product is assembled in a configuration not shown or approved by SRT

Assembly and disassembly may create pinch and cut hazards. Wear appropriate gloves and keep fingers away from slots, joints, tabs, and closing panels.

Never assemble, adjust, or disassemble a product while it is burning, contains hot fuel or ashes, or remains hot.

9. Outdoor Cooking Use

Use a product for cooking only when the product listing expressly identifies it as suitable for cooking.

Use cookware designed for open-flame or high-heat outdoor cooking. Center cookware carefully and confirm that it is stable before adding food or liquids.

Do not use oversized, unbalanced, damaged, or excessively heavy cookware that could cause the stove, rack, or cooking vessel to tip or collapse.

Do not allow food to contact painted, powder-coated, chemically treated, or otherwise non-food-contact surfaces.

SRT products do not control food temperature, prevent foodborne illness, or replace proper food-handling procedures.

Any decorative cooking-temperature chart, sign, or wall art sold by SRT is an informational decorative reference only. It is not a measuring instrument and is not a substitute for a calibrated food thermometer or current government food-safety guidance.

The purchaser and user are responsible for safe food storage, preparation, cooking, temperature verification, serving, and cleaning.

10. Bare Steel, Rust, Patina, Paint, and Finish

Bare steel naturally oxidizes and may develop rust, color variation, scale, patina, or surface staining.

Bare steel may transfer rust or discoloration to concrete, masonry, walls, flooring, clothing, furniture, or other nearby surfaces.

Painted, sealed, or coated finishes may scratch, chip, fade, weather, or corrode, particularly when exposed to sunlight, moisture, salt, chemicals, abrasion, heat, or outdoor conditions.

Unless expressly identified as heat-rated, painted or coated products must not be exposed to fire, cooking heat, hot ashes, or other high-temperature conditions.

Minor variations in dimensions, steel tone, paint application, weld appearance, grinding marks, patina, alignment, and hand-formed components are normal characteristics of handmade metal fabrication and are not necessarily manufacturing defects.

11. LED Lighting and Electrical Components

Where lighting or electrical components are included, use only the supplied or manufacturer-approved power supply, wiring, controls, connectors, and accessories.

Follow all instructions and ratings provided by the electrical-component manufacturer.

Do not use an indoor-rated component outdoors or in a wet or damp location.

Disconnect power before installation, adjustment, cleaning, or service. Do not use damaged wires, plugs, power supplies, connectors, batteries, or controls.

Outdoor electrical installations must use components and connections suitable for outdoor exposure and must comply with applicable electrical codes.

A qualified electrician should perform any installation requiring permanent wiring, modification of building wiring, or work for which electrical licensing is required.

Lighting accessories manufactured or sold by third parties remain subject to the third party’s instructions, ratings, warnings, and warranties.

12. Custom Designs and Fabricated Products

The customer is responsible for reviewing and approving all applicable dimensions, spelling, wording, orientation, layout, artwork, mounting-hole placement, intended use, and design details before fabrication.

Customer-supplied dimensions, drawings, photographs, files, measurements, and specifications are presumed to be accurate unless SRT expressly agrees in writing to independently verify them.

Unless expressly stated in a separate written agreement signed by SRT, custom products are not represented as:

Professionally engineered
Architect-approved
Code-certified
Load-rated
Crash-tested
Fire-rated
Food-service certified
Electrical-certified
Suitable for fall protection
Suitable for overhead lifting
Suitable for towing or vehicle recovery
Suitable for pressure-containing service
Suitable for personnel restraint
Suitable for life-safety use
Suitable as a required machine guard or structural safety system

The customer is responsible for determining whether a custom product is appropriate for the customer’s intended use and whether professional engineering, permitting, inspection, certification, or code approval is required.

Do not use a decorative or nonrated custom product in a safety-critical application.

Customer-requested modifications may affect strength, balance, heat behavior, mounting, durability, or safe operation.

13. Unauthorized Modification and Repair

Do not cut, bend, drill, weld, grind, enlarge openings, remove supports, alter mounting points, substitute components, or otherwise modify an SRT product unless the modification has been expressly approved in writing by SRT or performed by a qualified person who accepts responsibility for the modification.

Unauthorized modifications may create sharp edges, weaken the product, change its balance, increase fire risk, interfere with assembly, or cause mounting or structural failure.

Any applicable SRT warranty may be voided by unauthorized modification, misuse, improper repair, or use outside the product’s stated purpose.

14. Apparel and Branded Merchandise

SRT shirts, hats, and other branded merchandise are ordinary apparel unless expressly stated otherwise.

They are not personal protective equipment and are not represented as flame-resistant, arc-rated, cut-resistant, high-visibility, chemical-resistant, or suitable for welding, grinding, firefighting, or other hazardous work.

Follow the product’s care label and keep loose clothing away from open flames, rotating machinery, tools, and hot metal.

15. Inspection, Damage, and Safety Incidents

Inspect every product promptly upon delivery or pickup.

Photograph shipping damage before discarding packaging. Do not install or use a product that appears damaged, unstable, incomplete, incorrectly fabricated, or unsafe.

Stop using the product immediately if it:

Cracks, separates, bends unexpectedly, or becomes unstable
Develops a loose weld, tab, pin, fastener, bracket, or support
Produces unexpected flame behavior
Fails to remain properly assembled
Falls or detaches from its mounting
Develops an edge or condition that could cause injury
Is involved in a fire, tip-over, collapse, impact, electrical event, or other safety incident

Preserve the product, components, packaging, photographs, order information, and other evidence related to a reported defect or incident unless immediate disposal is necessary to protect people or property.

Provide SRT a reasonable opportunity to inspect the product when legally appropriate.

16. User Responsibility and Misuse

The purchaser, installer, owner, and user are responsible for following:

Applicable fire codes
Burn bans
Building codes
Electrical codes
Property restrictions
Homeowners’ association rules
Campground rules
Manufacturer instructions for third-party components
Other applicable laws and regulations

To the fullest extent permitted by law, SRT is not responsible for loss, injury, death, or damage to the extent caused by:

Failure to follow warnings or instructions
Indoor or enclosed-space operation of a fuel-burning product
Use of prohibited fuels or accelerants
Improper assembly
Improper installation or mounting
Inadequate fasteners or structural support
Overloading
Unsuitable placement
Unattended operation
Unauthorized alteration or repair
Continued use after damage or deterioration
Use during prohibited weather or fire conditions
Use for an unintended or safety-critical purpose
Customer-supplied measurements, specifications, or designs
Conduct of an installer, user, owner, recipient, or third party

17. WARRANTY DISCLAIMER

THIS SECTION IS INTENDED TO BE CONSPICUOUS.

EXCEPT FOR ANY EXPRESS WRITTEN WARRANTY SPECIFICALLY PROVIDED BY SRT METALWORKS FOR A PARTICULAR PRODUCT, AND SUBJECT TO ANY RIGHTS THAT CANNOT LAWFULLY BE DISCLAIMED, ALL PRODUCTS ARE PROVIDED AND SOLD “AS IS” AND “WITH ALL FAULTS.”

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SRT METALWORKS DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTY OF MERCHANTABILITY AND THE IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE.

SRT DOES NOT WARRANT THAT A PRODUCT WILL BE SUITABLE FOR A PARTICULAR LOCATION, MOUNTING SURFACE, LOAD, CLIMATE, BUILDING, VEHICLE, MACHINE, COMMERCIAL APPLICATION, SAFETY-CRITICAL APPLICATION, OR CUSTOMER-SPECIFIED PURPOSE UNLESS THAT SUITABILITY IS EXPRESSLY CONFIRMED IN A WRITTEN DOCUMENT SIGNED BY SRT.

Nothing in this section eliminates an express written warranty that SRT specifically provides for a product or any warranty or consumer right that applicable law does not permit SRT to exclude.

The SRT Return and Refund Policy remains separately applicable according to its terms.

18. LIMITATION OF LIABILITY

THIS SECTION IS INTENDED TO BE CONSPICUOUS.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SRT METALWORKS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL ECONOMIC DAMAGES ARISING FROM THE PURCHASE, POSSESSION, INSTALLATION, USE, MISUSE, MODIFICATION, OR INABILITY TO USE A PRODUCT.

FOR CLAIMS INVOLVING PROPERTY DAMAGE OR ECONOMIC LOSS ONLY, AND TO THE FULLEST EXTENT PERMITTED BY LAW, SRT’S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT ACTUALLY PAID TO SRT FOR THE PARTICULAR PRODUCT GIVING RISE TO THE CLAIM.

This limitation does not exclude or limit liability for personal injury, death, fraud, gross negligence, willful misconduct, violation of a nonwaivable consumer-protection right, or any other liability that applicable law does not permit to be excluded or limited.

Nothing in this notice waives a consumer’s rights under the Texas Deceptive Trade Practices–Consumer Protection Act or any other right that cannot legally be waived.

19. Acknowledgment

By purchasing, accepting delivery of, assembling, installing, gifting, possessing, or using an SRT product, the purchaser or user acknowledges that:

Metal and fire products involve inherent and foreseeable hazards.
The purchaser or user has received or had access to this notice.
The purchaser or user is responsible for reading and following all warnings and instructions.
The purchaser must provide the warnings and instructions to any installer, recipient, subsequent owner, or user.
Safe installation, placement, maintenance, and operation remain the responsibility of the person controlling the product.

20. Governing Law and Severability

To the extent permitted by applicable law, this notice and any dispute involving an SRT product are governed by the laws of the State of Texas.

If any provision of this notice is determined to be invalid, illegal, or unenforceable, that provision shall be enforced to the maximum extent legally permitted, and the remaining provisions shall continue in effect.

Nothing in this notice deprives a consumer of any mandatory protection provided by the law of the consumer’s state or jurisdiction.
